Decision on indicting PAD leaders put off

Public prosecutors yesterday decided to postpone to January 21 next year their decision on whether to indict nine leaders of the People's Alliance for Democracy (PAD) on charges of illegal assembly, inciting unrest, and resisting police orders.

The nine PAD leaders facing charges are Sondhi Limthongkul, Piphob Thongchai, Somsak Kosaisuk, Somkiat Pongpaiboon, Suriyasai Katasila, Chaiwat Sinsuwong, Amorn Ratananont, Terdpum Jaidee, and Maj-General Chamlong Srimuang.

But Chamlong and Chaiwat need not report to the prosecutors because they had been arrested and released on bail. If prosecutors do not indict Chamlong by November 21, and Chaiwat by November 24, both would be freed.

Chamras Atsuriyanant, special prosecutor of Criminal Litigation Division 5, told the suspects that public prosecutors needed more time to question additional witnesses.

Nitithorn Lamlua, a PAD lawyer, said public prosecutors would have to question about 20 witnesses who are academics, legal specialists and other witnesses. He also submitted circumstantial evidence such as statements by the PAD and the complaints levelled by the PAD with the National Anti-Corruption Commission that showed the intention of their action.

As this developed, the 82 "Srivicha Warriors" have denied the charges filed against them during their first court hearing after they were indicted for raiding and destroying the property of the NBT station.

Thanet Kamchum and 81 others who are the PAD guards were charged with racketeering, inciting unrest, illegal invasion and destruction of properties and carrying firearms in a public place, coercion and intimidation, assault with arms after they raided the NBT station on the early morning of August 26.

The court will start hearing the case on January 19.
