
On June 9 at about 9pm, Boonchan Aksornsuwan gave Thana Bt2 million in cash as part payment for the purchase of his house. The next day, Thana met with court officials. Thaksin and Pojaman were due to report to the court after returning from overseas.
Thana had his wife prepare a gift for court officials as thanks for their good service. She put a bag of chocolates on the back seat of Thana's car. The bag containing the Bt2 million in cash was put in the trunk for deposit at a bank.
When arriving at the court, Thana met lead lawyer Pichit Chuenban. He told his driver to pick up the bag in the back seat and follow him to the fourth floor of the building. When Thana was walking towards the lawyer's room, he met legal assistant Supasri Srisawat. He told her to send for a court official named ML Thitipong to meet him in the room. Thana then entered the room to talk with Pichit.
The driver then arrived with a paper bag and left it on a table. Pichit left the room. At the same time, ML Thitipong walked in and Thana talked to him. Thana thanked him for his cooperation over appointments and security matters. Thana said he had a gift for the official and his team. Thitipong asked what it was and Thana said he'd brought some sweets. Thitipong got up and took the bag with him.
When Thaksin arrived at the court, he waited inside the lawyer's room along with Pichit, Thana and Bannapot Damapong. Later, someone told Thana to meet a court official at the counter in the complaints admission division. A male official opened the door and handed Thana the paper bag, saying Thitipong wanted it to be returned to him. Thana accepted the bag and told Police Lt Colonel Wathanyu to put it in his car.
After Thaksin reported to the court, he went home. Thana waited for Pojaman to arrive, who reported to the court and left. Thana returned to his car and asked the driver if Wathanyu had returned the bag. The driver said it was in the trunk.
Thana said he suspected something was wrong. When he opened the bag in the trunk, he discovered it was the one containing the Bt2 million. Thana later found the bag of chocolates was left on the back seat. He asked his driver which bag he took with him into the court in the morning and the driver said it was the one in the trunk. Fearing a problem, he asked Pichit to arrange for an appointment with Thitipong to settle any misunderstanding. Pichit later told Thana Thitipong had reported the matter to his supervisors.
