'no evidence' to dissolve chart Thai and matchima thipataya

The Attorney General has rejected dissolution for the Chart Thai and Matchima Thipataya parties on grounds of insufficient evidence, a source said yesterday.



The prosecutor's panel headed by Deputy Attorney General Chulasing Wasantasing found the case against the parties was not solid and needed further investigation.

The prosecutors will notify Election Commission (EC) chairman Apichart Sukhagganond on behalf of the political registrar of their decision today, the source said.

Under Article 95 of the Constitution, if the prosecutors reject indictment, the political registrar must set up a joint panel comprising representatives of the Office of Attorney General and the political registrar to further investigate the allegation.

Apichart has the right to appoint prosecutors to the joint panel.

Chulasing is expected to be appointed as a panel member since he has worked on the case from the beginning. The joint panel must reach a decision within 30 days and if the panel does not agree to indict the suspects, the political registrar can file a suit with the Constitution Court.

Sources said prosecutors wanted to further investigate the ruling by Provincial Election Commission in Chai Nat and Prachin Buri because the suspects were not red-carded by the provincial election commissioners.

Chart Thai deputy-secretary general Monthien Songpracha and Matchima Thipataya Party deputy leader Sunthorn Vilawan were given red cards by the EC. Under new electoral rules, a political party is accountable for electoral offences involving party executives.
