Lawyer faces prosecution

Police yesterday recommended the prosecution of lawyer Thana Benjathikul on a charge of contempt after he criticised a verdict seen as unfavourable to the deposed government.

Thana was the chief legal counsel of deposed premier Thaksin Shinawatra and could face a jail term of up to seven years and a fine of Bt2,000 to Bt14,000 if found guilty of disrespecting the ruling.

The police report was based on Thana's remarks attacking the Criminal Court for finding the three election commissioners guilty of dereliction of duty relating to the botched April 2 election. It cited the 134-page transcript of comments and statements from eight expert witnesses as evidence.

Thana countered that his remarks had been distorted in news reports.

Kitti Busayapalakorn, deputy chief prosecutor for criminal litigation, is scheduled to rule on November 3 whether to try Thana.
