Top court acquits Adisai over job move

The Supreme Administrative Court yesterday acquitted a former education minister for issuing an order two years ago announcing internal job openings for positions already held by senior officials heading regional education offices.
The decision overturned a lower court's verdict in June that invalidated the announcement made on March 8, 2004, by Adisai Bodharamik and the Teachers' Council to seek more officials with extra qualifications to oversee regional offices. Thawat Oo-wichien, director of a regional office, and 20 other officials said Adisai and the Teachers' Council issued the order before an organic law became effective. Yesterday's verdict said the law became binding in regard to matters related to Adisai's announcement - supervision of education offices and internal management. It also said Thawat and the 20 other officials applied for jobs announced open by the order. The officials failed a test and later lodged the complaint. But the fact they undertook the test was proof they accepted the legitimacy of the minister's announcement.
