Reshuffle 'needs EC check'

The Pracharaj Party filed a petition yesterday asking the new Election Commission (EC) to determine whether the caretaker government's planned transfer military officials is constitutional, party member Somprasong Pongsiridul said.
According to Article 215 of the Constitution, a caretaker Cabinet is banned from transferring or sacking state enterprise workers or salaried officials unless it has the permission of the EC, Somprasong said.Some EC officials earlier interpreted the law to mean that the transfer of military officials did not need EC approval. Only transfers that need Cabinet approval require EC approval, and military transfers do not need Cabinet approval, they said. However, another group of EC officials said the military reshuffle needs EC approval because it results in advantages and disadvantages to political parties, Somprasong said.
