EC official's suit rejected

The Central Administrative Court yesterday rejected a petition from a senior Election Commission official who filed a suit against a Supreme Court decision that judges might not nominate candidates for vacant EC seats.

Chief Judge Boon-anan Wanphanich said the Administrative Court had rejected the file because it was not within the court's authority to overrule the Supreme Court.

So the Supreme Court's ruling stands: it is not within the Administrative Court's remit to nominate EC candidates.

Phirapong Phairin, deputy director of the policy and planning division of the EC's Office, filed suit in the Central Administrative court on June 7 against the Supreme Court decision.

He argued he had been deprived of the chance to stand as a candidate as a result of the decision.

He said the decision of the Supreme Court judges restricted his rights as guaranteed by Articles 28 and 62 of the Constitution.

The court did not agree.
